An executive order for a new travel ban was signed in March by President Trump, which had very few changes from the original travel ban. The rewritten order would have banned people from Iran, Libya, Somalia, Sudan, Syria, and Yemen from entering the US for 90 days, and all refugees for 120 days. As a result, the order would also have cut the number of refugees to be accepted this year from 110,000 to 50,000.
Judge Challenges Executive Order
Judge Derrick Kahala Watson decided that the state of Hawaii would challenge the executive order. The travel ban had a strong likelihood of success due to claims that the president’s action would break protections against religious unfairness and would hurt Hawaii’s tourism industry.
Judges Block Executive Order
Judge Watson granted a temporary restraining order, blocking President Trump’s revised executive order banning entry of nationals from six Muslim countries into the United States from going into effect. Watson held that the order would violate the First Amendment’s Establishment Clause in that a “reasonable, objective observer would conclude that the Executive Order was issued with a purpose to disfavor a particular religion.” On March 29, 2017, Watson converted the temporary restraining order into a preliminary injunction.
Judge Watson’s ruling on the new executive order means people from the six Muslim countries will be able to travel to the United States. Federal Judge Theodore Chuang of Maryland also joined forces with Judge Watson, and blocked the 90-day ban on immigration. Consequently, Judge Derrick Watson has received threats after his ruling and now has 24 hour protection.
