DRUNK DOES NOT EQUAL CONSENT
Canadian women in Halifax, New Brunswick, spent their International Women’s day making a stand against sexual assault. They stood outside a courtroom to protest the acquittal of Bassam Al-Rawi as he got away with (allegedly) raping a drunk passenger.
Strangers found the victim on May 15, 2013, naked from the breasts down in Al-Rawi’s cab with no recollection of the event.
While there was no doubt the woman was too drunk to verbally say YES the court felt she wasn’t so drunk she couldn’t say NO and took that as her giving consent. The Judge even made it a point to say, “a lack of memory does not equate a lack of consent…. Clearly, a drunk can consent.”
However, the judge neglected to consider the feelings of shame, violation, and impact. The trauma from sexual assault can last a lifetime and it’s something a survivor will live with every single day.
